Welcome to Market Monolith. These Terms of Service (“Terms”) govern your use of the Market Monolith platform (“Platform”), operated by HotSwop, Inc. (“Company,” “we,” “our,” or “us”).

By using the Platform, you agree to be legally bound by these Terms. If you do not agree, do not access or use the Platform.

1. Overview of Services

Market Monolith is a cloud-native orchestration platform for deploying and managing e-commerce infrastructure. Access to certain features and compute resources is granted through the purchase and use of Credits. These Credits are not a form of currency and have no cash value—they are prepaid units for computational tasks on the platform.

2. Accounts

• You must be at least 18 years old.
• You agree to provide accurate and complete registration information.
• You are responsible for all activities that occur under your account credentials.

3. Credit-Based Billing

• Purchasing Credits: Credits are purchased through Stripe. You agree to Stripe’s Services Agreement.
• Usage: Credits are consumed by compute tasks or infrastructure provisioning.
• Non-transferable: Credits may not be transferred, resold, or converted to cash.
• Expiration: Unused credits may expire after 12 months (subject to our policies).

4. Pricing & Payment

All prices are listed in USD unless otherwise specified. Payments are securely processed through Stripe. You are responsible for applicable taxes and fees.

5. Refund Policy

All purchases of Credits are final and non-refundable. If you believe a billing error occurred, contact us at scale@marketmonolith.com within 7 days of the transaction. Refunds are only issued where required by law.

6. Acceptable Use Policy

You agree not to:

• Use the Services for illegal or abusive purposes.
• Disrupt or interfere with the Platform or other users.
• Attempt to access accounts or data not belonging to you.
• Engage in reverse engineering or security circumvention.

Violations may result in account suspension or termination.

7. Intellectual Property

All content and code on the Platform are owned by HotSwop, Inc. or its licensors and protected under applicable intellectual property laws. Unauthorized use is strictly prohibited.

8. Limitation of Liability

The Platform is provided “as is” without warranties. To the fullest extent permitted by law, we are not liable for indirect or consequential damages including loss of data, revenue, or profits.

9. Indemnification

You agree to indemnify and hold harmless HotSwop, Inc. from any claims, liabilities, or expenses arising from your use of the Platform or violation of these Terms.

10. Modifications to Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance. The “Effective Date” above will reflect the most recent revision.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
