Operator relationship
This Operator Agreement supplements the Terms of Service and applies between you and HotSwop, Inc. when you apply to or participate in the Market Monolith Operator Network. If you operate through a business, “Operator” includes you and that business.
Operators are intended to provide services as independent contractors, not as employees, agents, franchisees, partners, or joint venturers of HotSwop or a customer. You have no authority to bind either one. The actual relationship and nonwaivable rights are determined by applicable law and real operating facts, not this label alone. Nothing in this Agreement waives a right that law does not permit you to waive.

Eligibility and verification
You must be at least 18, legally authorized to perform the work where offered, and able to enter this Agreement. You must provide accurate identity, contact, business, tax, payment, qualification, capability, license, insurance, and market information when requested.
Some opportunities may require training, certification, screening, customer approval, identity verification, access credentials, equipment, driving eligibility, or other readiness. Meeting readiness requirements does not guarantee an opportunity. We may reverify information and must satisfy customer, safety, payment-provider, financial-partner, and legal obligations.

Choice and independence
You decide whether to review, accept, or decline an available opportunity and may work for others, including competitors, subject to confidentiality and accepted commitments. You control when to make yourself available. There is no minimum acceptance rate, exclusivity requirement, or guarantee that opportunities will be offered.
After accepting an opportunity, you agree to complete the defined work by the agreed time and standard or promptly use the release, help, or escalation process. Freedom to choose an opportunity does not authorize you to change its scope, route boundaries, approved message, proof standard, rate, or customer commitments without approval.

Opportunities and acceptance
An opportunity should identify the customer or program context, territory or location, tasks, expected timing, rate or earnings method, required capabilities, materials, proof standard, known expenses, and material conditions. Details may be updated before acceptance. You should ask questions before accepting if the work is unclear.
A recommendation, map marker, availability notice, invitation, readiness match, capacity estimate, or preview is not an assignment. Work is accepted only through the stated Platform action or written confirmation. We may remove an unaccepted opportunity, and an opportunity may be unavailable by the time you respond.

Rates, earnings, and expenses
The applicable rate or calculation will be shown before acceptance. Rates may vary based on market conditions, role, skill, complexity, geography, local availability, timing, duration, travel, materials, risk, customer requirements, and proof standard. Examples elsewhere on the Platform are illustrations, not package prices or earnings guarantees.
Unless an opportunity says otherwise, earnings become payable after the required work and proof are submitted and accepted. We may review a disputed portion, request a correction permitted by the opportunity, or reject work that was not performed, was outside scope, was unsafe or unlawful, or used false proof. We will not withhold an undisputed accepted amount merely because another portion is under review.
You are responsible for ordinary business expenses unless the opportunity identifies a reimbursement or an approved Platform-funded purchase. Never incur an expense in another person’s name or assume it will be reimbursed without prior approval.

Readiness and lawful standards
Training, briefings, playbooks, customer standards, and Platform guidance communicate the lawful outcome and quality requirements of specific work. They do not guarantee access or eliminate your responsibility to use reasonable professional judgment.
You must follow the Acceptable Use Policy, applicable law, safety requirements, location rules, approved claims, privacy instructions, and customer-specific requirements stated in the opportunity. Tell us if instructions conflict, are unclear, appear unsafe, or would require a license or permission you do not have.

Field work and safety
Use lawful routes and public or authorized access. Respect property, residents, businesses, venue personnel, no-solicitation notices, operating hours, parking, traffic, building, accessibility, and recording rules. Never enter a residence, trespass, damage property, work while impaired, carry a weapon during an opportunity, or continue through a condition you reasonably believe is unsafe.
You may stop and report a safety or legal concern. In an emergency, contact local emergency services first. Use Platform support for route problems, materials, customer questions, incidents, harassment, unsafe conditions, or inability to complete. Do not improvise a customer promise or confront a person who declines interaction.

Proof and quality review
Proof connects work to the approved plan. Submit only authentic, assignment-specific evidence captured at the relevant time and place. Do not stage, recycle, fabricate, backdate, materially alter, or generate false proof. Use privacy redaction only where permitted and do not capture more personal information than the task requires.
HotSwop, the customer, and authorized reviewers may evaluate proof against the disclosed standard. A review may accept, request a specific correction, identify missing evidence, or reject work with a reason. You may use the available appeal or support process and provide context. Accepted proof and review history become part of your Platform work record.

Customer data and confidentiality
Campaign plans, routes, contacts, product information, access instructions, unannounced launches, prices, customer data, proof, conversations, and other nonpublic information are confidential. Use them only for the accepted work, protect them from unauthorized access, and delete local copies when no longer needed except where retention is required.
Do not contact a customer’s prospects or locations outside the opportunity, build your own list from Platform data, share screenshots or recordings publicly, or use confidential information to compete with or solicit a customer. Confidentiality does not cover information you lawfully knew without restriction, independently developed, or received lawfully from another source.

Work product and content
You retain rights in original materials you create outside an opportunity. To the extent an opportunity pays for customer-specific deliverables, you assign those deliverables to HotSwop for transfer or license to the customer upon payment, excluding your preexisting tools and general know-how. You grant HotSwop the license in the Terms to process proof, communications, and submissions for Platform operation, review, records, disputes, and improvement.
You must have permission for what you submit and must respect copyright, trademark, privacy, publicity, trade-secret, and recording rights. Do not include music, images, faces, confidential documents, or locations that are unnecessary or unauthorized.

Tools, materials, and cards
Unless the opportunity says otherwise, you provide ordinary tools, a compatible device, connectivity, transportation, and attire appropriate to lawful independent work. Customer-branded materials or access items remain the owner’s property and must be used only for the opportunity and returned or disposed of as directed.
A future operator card is not earnings or a personal benefit. It would be available only after separate program approval and separate acceptance of Stripe, bank, E-Sign, cardholder, and Platform card terms. Review the Operator Card Policy for the intended boundaries.

Tax, insurance, and licenses
You are responsible for your business registration, tax filings, permits, licenses, insurance, equipment, and expenses except where law or an accepted opportunity states otherwise. HotSwop may collect tax information, report compensation, withhold amounts required by law, and verify qualifications.
If the law in a jurisdiction treats you differently from the relationship described here, that law controls. Contact us before accepting work if you believe a required classification, license, insurance policy, accommodation, or legal obligation is not reflected.

Feedback and records
The Platform may maintain completion, timeliness, proof, customer feedback, safety, communication, correction, and reliability records. Feedback is contextual and does not guarantee future work. We may use it to improve readiness, matching, support, and risk controls.
You may review information made available in your profile and request correction of inaccurate personal information under the Privacy Policy. Honest, lawful criticism is permitted; you may not submit retaliatory, discriminatory, fabricated, or manipulated feedback.

Suspension, deactivation, and appeal
We may pause opportunities or restrict access for expired qualifications, identity or payment review, repeated failure to meet disclosed standards, abandonment of accepted work, false proof, unsafe conduct, harassment, fraud, prohibited business activity, confidentiality breach, security risk, or legal or provider requirements.
When appropriate, we will state the reason and provide a way to respond, correct records, or appeal. We may act immediately for urgent safety, fraud, exploitation, sanctions, security, or legal risk. Deactivation does not erase undisputed accepted earnings. Accounts created to evade a restriction may be closed.

Disputes and changes
The dispute, arbitration, class-waiver, governing-law, disclaimer, liability, and indemnity provisions in the Terms of Service apply to this Agreement, subject to nonwaivable worker and state-law rights. Arbitration may be opted out within the period and by the method stated there.
We may update this Agreement prospectively and will seek new assent for material changes where required. Questions, payment concerns, safety reports, and appeals may be sent to hello@marketmonolith.com with a clear subject and the relevant opportunity reference.
